The Battle for the Conservative Future of the Supreme Court
The untimely death of the late supreme court justice Ruth Bader Ginsburg has created a dilemma that could shake the foundations of the Supreme Court for decades. The creation of a Supreme Court vacancy one month before an election has given Republicans in Washington the ability to elect an extra Supreme Court judge without worrying about winning an election in a presidential election year. The vacancy has also created a controversy of whether the American people should express their opinion in votes before the important seat is filled; However, regardless of what the American people think the sitting president Donald Trump has already appointed a Supreme Court nominee.
Amy Coney Barrett’s is controversial as a pick, but well qualified for the job. Judge Barrett was raised in New Orleans and received her undergraduate degree at Rhode College in Memphis, Tennessee. Barrett later served as a University of Notre Dame law professor for multiple years which had solidified her position as a “Scalia-esque” conservative. Barrett gained notoriety by being a clerk to the late Antonin Scalia and was praised multiple times for her adept nature. Barrett was appointed to be a federal judge of the 7th U.S. Circuit Court of Appeals by Donald Trump in 2017.
Barrett’s qualifications are well fit for the Supreme Court, but her opinions have created controversy among the left. Barrett has expressed her commitment to Roman Catholicism many times and this commitment to the faith has made her a target for people supporting abortion or gay rights. The selection of a devout religious candidate for the high court has fueled the battle between religious conservatives and liberals. Judge Barrett joining the court will add a heavy conservative hand to any future Supreme Court cases revolving around religion or reproductive rights.
The nomination of a devout Roman Catholic could directly threaten the infamous “roe v. wade” and possibly shape the future of abortion laws in America. Adding Barrett to the bench would give the court a majority of six justices who are Catholics. With a strong religious conservative added to an already majority conservative court, liberals fear an upcoming wave of anti-abortion laws that will turn back the clock to the 1900s. Judge Barrett could solidify Trump’s legacy as turning the country judicially conservative for the next few decades.
